City of Fontana Cruise & Market Night

How Often Have You Been Asked If You Are an Organization Member?

Why is it everywhere we go, either as individuals or as an organization we are asked if we are members of the AMA, ABATE or NHRA to name a few? When asked, we truthfully reply NO. Why is this you might ask? The answer is quite simple.

The answer is not because we do not want too, but because we as a Domestic 501(c)(3) organization can not. We are barred by the IRS through determination rulings. All exempt 501(c)(3) organizations are barred from providing a direct benefit to another such as the AMA.

What! We can not become a Charter Promoter or Club with the AMA? NO. We consulted with the Ohio Tax Exempt & Government Exempt Office and asked the question about membership as explained to us by the Club & Promoters representative for the AMA. Two of the requirements were that at any event we have under this charter must be for AMA Members. The second is if participants are not AMA Members, that we are to solicit the non-members in becoming AMA Members.

These requirements clearly and legally violate the determination rulings set forth by the IRS. Therefore, directly jeopardizing the 501(c)(3) organization's status due to this direct benefit extended to the membership body to which is granting the Charter Membership under their requirements. A direct benefit.

Until that time when such memberships do not require this direct benefit from 501(c)(3) organization's such as ours. We must lawfully abstain from becoming members to avoid status violations whether we would enjoy the benefits in becoming AMA members or not.
