Upon closer inspection... Mother fucker! Someone ran over my bike!

Hmmm, exactly...

Were the police called to the scene of the accident? Was the driver charged?

I'm guessing 'no', since the neighbors have the info and they moved the bike back to the curb.

That's a lot of property damage and alleged drunk driving for the cops not to be called until much later, don't you think?

At this point, since the parties involved have the legally required information from the accident, and the scene has been cleared, the police have no need to respond for any report. That's NOT their 'fucking job'.

Again, were the police called to the initial scene or not?

Question- Who owns the black car, and the apartment complex? The driver's insurance should be hearing from a LOT of people right now. Give the info to yours, and they should take care of the rest. If that doesn't work, Get the claim number from the other parties and contact the driver's insurance. If she managed to hit two vehicles, and a gate, there's obviously no way it's your fault.

That's so fucked-up. I don't know about CA, but in WI you have to report any accident above a certain dollar amount. Your bike looks like it alone would cover it.

If the neighbors have the info, my guess is the cops weren't called. The cops would have gotten the OP down to the scene.

Here you do too. Over $500 in damage, you call the cops and they're supposed to come. Unless they don't feel like it, then they'll tell you it's private property and they can't interfere, or that they don't write incident reports for blah blah blah. But I can only speak for the shitty San Diego police.

Neighbors (or someone) had called the police. In order for them to come out and file a report, the one of the following has to occur:
* The traffic collision occurred within the City of Los Angeles.
* A person involved in the traffic collision has been injured (complaining of pain is considered an injury) or dies.
* One of the drivers is under the influence of alcohol or drugs.
* One of the drivers has fled the location without stopping to exchange information or check on the welfare of the other parties involved.
* City property is involved (City vehicle, light post, signal post, etc.)

Now, you might argue that the 3rd bullet there has been met, but, apparently no one reported that the driver was under the influence, so police never came, and a report never made. I know this, because I called the police station, and they told me they had received multiple calls about this incident already.

Next up, I call the driver's insurance (Allstate) to file a claim, and guess what? They already have one ready for me. So I provide them w/ my additional info and thats that.

Now I have to get a repair estimate so I can turn that in to Allstate. Sigh... which means I gotta pay someone to tow the broken 250. No, I don't know anyone who owns a pickup.

If it did not occur within the jurisdiction of LAPD, then the proper authorities were not called.

When one vehicle strikes multiple vehicles and causes property damage and is suspected of being under the influence, the proper authorities should be notified immediately. She just got a freebie if she was drunk.

At least she left her legitimate information! What if she hadn't?
And if she had caused additional damage or injuries after she left that scene because she was drunk, it would've been on your neighbors' conscience, if not worse.

Don't listen to Gypsy. He's just bitter. He was wrong in his assumptions here about the cops doing their fucking job. There's plenty of opportunity to rag on the cops. Might as well be accurate when you do it.

Cops here don't respond for an accident report unless there are injuries, the vehicles cannot be driven, government property, impairment, etc... So what? You don't need a police report for minor accidents, unless one of the drivers is uninsured, unlicensed, or impaired. I see people all the time blocking lanes of traffic waiting for the police over minor fender benders. :bitchslap

As I said, you have the driver's information, luckily. That's all you need to worry about. File the claim against her insurance company, as you already did. :cheers

have allstates insurance adjuster come out no need to spend your own money. But at least move it off the street. Or have a repair shop have someone come out and just mention that insurance will be paying for it so they come out
What you need to do is get drunk, and drive your car into that bitches house, and then leave....

there shouldn't be a dime coming out of your pocket, to be honest the bike is totaled. at only 3k new its gonna cost more than that to fix it at a dealer, what you should be doing is if there is no frame damage or bent forks and its all pretty much cosmetic damage is get the check for the totaled out bike from the insurance company and buy it back from them for cheap($500 max) and make it a street fighter and sell it.

dont take any shit from the insurance company they OWE you that bike fixed into as new condition by who ever the hell you want

If the adjuster from Allstate doesnt total your bike out then go to a dealer and have them assess it for repair costs and labor. Tell them you want to replace everything that has even the slightest scratch on it.

You should be getting a new bike though. If I was your neighbor and I saw it happen I would have ran out with my camera and taken pictures while calling the police.
