A guy brings his duc in for service, returns to find they have loaned it out. I'd tear someone a new A.

O.K., I'm new to the monster board, I have an 02 620, bought new this year (leftover, great price). I Like the bike a lot.

Anyway, the first service was free, so I took my bike in and left it for service. They said it would be ready the next day. I went back after work the next day, and they said they couldn't find my bike! While I was there they started looking for it, and found that the previous day another customer dropped of his bike for service, and TOOK MINE as a LOANER! WTF! There was an additional 80 miles on the bike, and I find the clutch letting out closer to the end of its travel. I'm really pissed about this.

Any advice or comments? Anyone have anything similar happen to them?

your kidding right?!

ok first off, besides NEVER going back there again, dont freak till you have them admit it, have someone with you to confirm that they lent it out. next, GET A LAWYER... Im not a sue happy person, but I'd sue!!

Return the bike and tell them that you want a complete over haul of your bike new seals, new clutch , new everything because you know as well as I do that I the shop gave me a loaner I'd beat the shit out of it. If they want to give you a hard time tell them you are going to get a lawyer and you will file a complant with the BBB (better business bureo). That is total bullshit man I'd be flippen the hell out!

Wasting time with a lawsuit is dumb. I'd go for criminal charges, possibly along the lines of theft of a motor vehicle. See if maybe put that stealership outta business.

I'd be walking out the door with as much gear and store property as I could carry, afterall they gave your bike away. What are they going to do, call the police? I know as the bikes owner I would........

It wasn't me or my bike, I'm just trying to spread the word. Like mark mitusubishi, or the dealer in washington w/ the burn out problem. These things only get better with more publicity, if they feel it in their pocketbook, it will discourage it from happening again. It will also warn people about their bad practise.

Oh man. How stupid can the people at this dealership be! I would definately be in contact with a lawyer ASAP!!!

yes, but you'd still need a lawyer to back ya up.. they have b***** and better ones then most ppl....

Talk to the shop owner and tell him your wife is away on a business trip and that if it's at all possible, if it's ok, you'd like to borrow his on a loaner agreement. Ok, ok, this isn't a very fair parallel comparision. After all, wives care if you ride other wives, bikes don't. No wait...what I meant to say is that wives aren't property.

See, though the bad thing is that he left taking the bike with him and ACCEPTING the free filter and $100 credit. He should have stayed at the shop, not accept the bike back, or hte offer of the shop and called the police to make ar eport while he was there; and then make a call to the Ducati manufacturer at that point to file a complaint, or get infomration.

By leaving with his bike and the "compensation" he pretty much agreed that "its done".
He can get a lwayer, but he wont have much t ofight because when they bring it, the judge is gonna ask if they offered anything to compensate, and he will have to say yes. The judge may determine that the compensation isn't worth the value of the abuse, and may offer some "cash reward" for what HE thinks is worth on the damage itself, but are you gonna be lucky to get a judge that undesrtands the workings of a $20,000 motorcycle?

well that guy can't do a damn thing because I took the filter and credit, basically completed a transaction.

The worst potential of that episode only came out later in the monster thread. That guy may be liable if anyone/anything got hurt while riding his bike unless he could prove that they didn't have his permission. Leaving the bike there for service may include implied permission for their "agents" to ride the thing. What a mess.

you could try to demand this, but if I was the shop owner i'd leave the bike in the back for a week, not touch it at all, then call the guy and tell him you did all that work. I know it's not ethical, but they don't seem to really care about ethics anyway.

$100 credit and a filter? Man, that guy's cheap. He had them by the balls at that point, with them basically haven stolen his bike. And no way was there implied permission to let another customer take it home, that's nuts. He had those 80 abusive miles put on during the breakin period, causing who knows what kind of damage to the bike, the liability if someone had been hurt on or by it, and he was deprived of its use for a period of time. I would definitely be talking new bike.
