I used to have this roommate. I met him because he works in the same industry as me, and was friend with some acquaintances of mine so I thought that was enough of a reference. Well in the 6 months he lived here he never once paid rent on time, and I eventually had to tell him to get out.

In addition to this, he was renting a room, but felt it was ok to gather extra truck parts and store them in a pile in the back yard (tires, axles, etc). I wasn't really ok with this and asked him to do something with the stuff when he lived here. He of course didn't. When he moved out he asked if he could leave the stuff for a month, and in exchange I could keep one of the axles (which I did want). After about a month and a half he called and said that he was gonna find a way to come get the stuff, and I haven't heard anything since. He moved out on may 15th.

At this point I'd really like the stuff gone, but dont really wanna deal with the guy. I'd really like to just throw the junk on craigslist and sell it (like he always claimed he was gonna do), but I kinda wonder if I should give him another chance to come get it. It's been 3 months, and it was supposed to never be there at all, so I think I've been pretty generous. What do you guys think I should do?

Cant send a certified letter, he's a loser, and at this point I'm pretty sure he resides on couches and in the back seat of his 4runner. I'm also pretty sure his phone has been turned off judging by the number of angry looking sprint envelopes that keep coming in the mail. I know where he works, and could get ahold of him, but I really dont think i should have to go out of my way for stuff he was supposed to get rid of months ago.

You shouldn't have to but you should anyway. always cover your own ass

Look, if you have the date he was supposed to move out then he was supposed to take all his shit with him that day. If you gave him 3 months already then sell it. Its not your responsibility to watch after his stuff. Technically you could have sold it the day after he moved out. Just sell the stuff, 3 months is enough time to give the guy...hes a flake...and you know it. Just sell it all and dont look back.

i don't know what the value of his crap is, but if you get rid of it, he'll be on your ass for the thousands of dollars he'll say it's worth. Send him the certified letter, giving him 30 days to dispose of it. Tell him that if he fails to remove it, he will be liable for the cost of removal. If is has any value, tell him in the letter that you will recoop the expense of selling it from the proceeds of the sales.

Get rid of it.

If he ever does come over to get it, tell him that it's gone and that you figured he had finally come to pick it up so you didn't think anything of it.

He'll think it was stolen. It will be out of your yard.

Problem solved.

Be careful. Check out your state's laws about this because you may incur some liability if you do the wrong thing. I think trying to get a registered letter to the guy is the best course of action, since you may need to prove that you made a reasonable effort to get him to get the stuff.

Most states its 30 days, but check. If its just some crappy car parts, and he really is homeless, the chances of him actually taking you to court would be minimal, I would think. I would junk it, but thats my opinion.

You need to CYA. Absolutely send a certified letter. Send it to his employer's address if you have to.

Beyond that, check with your local sheriff's office. Every state is different. If you have nothing in writing, he has the upper hand. Sad, but I went through the same thing recently, and having everything in writing is the difference between being on top or being the bitch.

Certified letter? It has to be proven legit first. You need to make a Police Report before ANYTHING to make sure you arent in possession of stolen property-then send the letters.

Call the cops as them and they will check it out then tell you what you can do.

somehow I dont think the local cops are gonna wanna waste their time. We're talkin about some crappy wheels, and a pair of axles. None of it has any kind of serial numbers, and even if it did none of it is the kind of stuff that can be traced.

Send certified letter, wait for it to be received then count 30 days. After day 31, do as you wish with the stuff. Be sure to keep a copy of the letter.
where do you suggest I send it? I dont know where he lives.

I'm just saying, you'd be surprised at how quickly the crappy wheels and axles become polished mag wheels and aftermarket forged axles in a law suit. Putting in the effort now may spare you the effort later. Wouldn't it suck if this guy sued you, found a sympathetic judge and you end up having to come out of your pocket for that pile of garbage?
