Put a spacer on the mounting bolt, between the passenger peg bracket and the slip-on mounting clamp, shim out the position of the muffler... you may need a longer bolt if the space you need is that much greater.
Simpler solution, you can always try yanking on the muffler to pull it outward to avoid rubbing the swing arm.

I had the same problem with an install mod on my Tuono. I used washers as spacers to push the exhaust away from the swingarm, it worked.

Thanks. I fixed it by having a shop re-bend my mid pipe and I used a tad longer bolt to push it up and out of the swing arm. Now to repair the nice cut it left in the arm from rubbing so long
