OK, here is the situation. I am thinking about buying a bike, the person I am buying it from bought it a few months ago. When he bought the bike, the owner signed the title and gave it to him. THe person I am buying the bike from never signed or turned in the title to the dmv. Now looking at a title, I see "Note: Section 2113 of the Vehicle and Traffic Law requires that application for title must be made within 30 days of transfer". It has been longer then 30 days. I was going to get a loan for the bike but usually the bank cuts the check to the name on the title.... Has anyone ever had to deal w/ such a situation ( BTW, I am in NY State )

TIA

Mike

I had a similar incident with my old Ninja. the guy I bought it from did the same thing as in your situation- he bought the bike, rode it, but without registering it. after I bought it and went to the DMV they told me HE had to pay taxes on it before I could register it. make a long story short- the bike was 9 yrs old, so the first season I rode it unregistered and the next year I registered it without the title ( 10 yrs. and older doesn't need a title in RI)

tell him to pay for the title to be put into this name (and any back taxes), then minu that from the price of the bike.

That would be known as title jumping.......and the DMV frowns heavily on it. They want their money from each sale of the bike in the form of taxes.....get him to properly register the bike in his name first, otherwise, RUN away.

have him get a new title with his name on it... THEN get the loan from him... this may take a couple days... shit.. maybe even weeks... but if the dude is for real then he'll have no problem doing that... but you gotta ask your self is the bike worth the wait... is it that good a deal that you can't just pass it up?
