WASHINGTON (Reuters) - The U.S. Supreme Court on Wednesday overturned the record $2.5 billion in punitive damages that Exxon Mobil Corp had been ordered to pay for the 1989 Exxon Valdez oil spill off Alaska.

This whole notion of punitive damages needs to be re-thought. Forget who the defendant is for a moment. I'm not sure arbitrary rulings on what constitutes "punishment" is the way to go.

In this case, I was especially impressed by Souter voting with the majority. And a 5-3 ruling is not exactly an indication of deep division within the court. (It's nice to have the cash to be able to drag these thing out in court for 19 years, I guess.)
