A Clay County woman's family said it's seeking justice after their loved one died shortly after being shocked 10 times with Taser guns during a confrontation with police.
The family of 56-year-old Emily Delafield said it would take the Green Cove Springs Police Department to court, according to a WJXT-TV report.
In April 2006, officers with the police department said they were called to a disturbance at a home in the 400 block of Harrison Street just before 5 p.m.
In a 911 call made to the Green Cove Springs, Delafield can be heard telling a dispatcher that she believed she was in danger:
Dispatcher: And what's the problem?
Delafield: My sister is waiting on my property.
Dispatcher: Your what?
Delafield: My sister (inaudible) is on my property trying to harm me.
Officers said they arrived to find Delafield in a wheelchair, armed with two knives and a hammer. Police said the woman was swinging the weapons at family members and police.
Within an hour of her call to 911, Delafield, a wheelchair-bound woman documented to have mental illness, was dead.
Family attorney Rick Alexander said Delafield's death could have been prevented and that there are four things that jump out at him about the case.
"One, she's in a wheelchair. Two, she's schizophrenic. Three, they're using a Taser on a person that's in a wheelchair, and then four is that they tasered her 10 times for a period of like two minutes," Alexander said.
According to a police report, one of the officers used her Taser gun nine times for a total of 160 seconds and the other officer discharged his Taser gun once for a total of no more than five seconds.
A medical examiner found Delafield died from hypertensive heart disease and cited the Taser gun shock as a contributing factor, the report said. On her death certificate, the medical examiner ruled Delafield's death a homicide.
The family said it plans to sue the Green Coves Springs Police Department now that it has all the reports regarding their loved one's death.
"We're going to try to compensate the estate and the family and try to get justice," Alexander said.
He said he believes the evidence weighs heavily in favor of Delafield's family and that justice will be served.
"I think that this evidence is going to show, along with some of the evidence we've collected outside of here, that there is no reason Emily Delafield should have died that day," Alexander said.
He said he plans to file a notice to sue sometime before the end of the year.
Yeah seriously. I hope that they get justice. I imagine that they could have disarmed her in a much less harmful way. Did she drop the weapons when they tazed her? My guess would be yes but it doesn't say. I guess all you police out there need to protect yourself from those wheelchair bound schizophrenics by lethal force. United States citizens are not your enemies. Good job.

How about tazing her once and using your knight stick to hit the weapons from her hand? Let's just keep tazing her, the previous nine times didn't work maybe the tenth one will. This brings up another issue dealing with police and mentally ill subjects. This woman needed help not a tazer.

After being tazed once it *is* possible that she could still hit them w/ a knife and/or hammer. As a cop I wouldn't risk my personal safety jumping in to disarm...that's like when you hear people say the cops should have shot the gun out of the bad guy's hand.
I don't know how mobile this women was, probably not too mobile as she's in a wheel chair and that lends itself to having a huge gaping blind spot on her backside. Knock the wheel chair over, maybe?
Seems like something is missing from the story, but on the face of it hitting a 'crip' in a wheel chair 10 times w/ the taser seems extremely excessive.
I can see a woman in a wheelchair being a threat to a "law enforcement officer."

So, you don't think she's able to throw a knife and hit someone in the head, causing damage and possibly death?...Whatever...Let her come at your loved one with a blade and see if you can "talk her through it"
I hope no kids were close by...But it's OK, she's harmless...No one ever did any damage from a wheelchair...

Omfg , push her ass over. Game over the police fail once again. How fast can a 56 year old woman in a wheelchair turn around while holding a knife and a hammer? Not nearly as fast as I can get behind her and disarm her, and Im not in that good of shape either. If you think she was dangerous you are retarded. I would laugh at her and then flip her over. Don't get all pissy cause 750 rider posted it. The police were wrong again.

If he was so concerned about the US law enforcement, he'd become LEO and strive to make changes for the better...He'd live here in the US..He'd get off his azz and lobby to make changes...It's just much easier to type on a keyboard and hide from any real confrontation...

So you are saying you are afraid of women in wheelchairs. Hmm...stay out of her distance until she tires herself out? If she tries to roll away, maybe slide a baton into the wheels. maybe two officers run on either side of her and cover her with a blanket. Be creative. TAZE TAZE TAZE...the mantra of our times.
Why not just put a magnum slug through her heart. Lot quicker and probably hurts less.
