PDT SAN MATEO - A San Francisco rookie police officer who shot himself to death during a late-night gathering at his San Mateo apartment was legally drunk, toxicology tests show.
Officer James Gustafson Jr., 23, had a blood alcohol level of 0.09 percent - slightly above the 0.08 limit for legally driving a car - when he shot himself Aug. 11, San Mateo County Coroner Robert Foucrault said today.
Gustafson shot himself in the neck at 1:40 a.m. during a gathering of as many as 15 people, as he was showing a woman how police are taught to prevent someone from using a gun against them, authorities said.
There's no way to know whether Gustafson was too drunk to know what he was doing, the coroner said.
"Somebody's blood alcohol level and their ability to function correctly can vary from individual to individual," Foucrault said. "It's subjective."
According to those familiar with the incident, Gustafson was showing the woman his Police Department-issued semiautomatic pistol after removing the magazine that stores the rounds. However, there was still a round in the chamber.
Gustafson pointed the weapon at his neck and pulled the trigger, shooting himself, according to authorities.
The coroner's office has ruled the case an accident. Police initially characterized the case as an accident but are awaiting official receipt of the toxicology results and gunshot residue tests before making a final determination, Lt. Mike Brunicardi said.
Gustafson graduated from the San Francisco police academy in January. He had recently finished a six-month stint in the Mission District under a field training officer and had been transferred to the department's Central Station.
Depends. If you dont know them and/or they do something incredibly stupid then its hard to feel sad for them.
In this case, i cant have sympathy for him. Its not a freak accident or anything. He would be alive if he had remembered some simple gun safety....hell ive never owned/fired a gun and i know not to dick around like that.

I'm sorry but I have sympathy for anyone who passes with few exceptions. If it were someone you knew, you'd feel bad no matter what the circumstances. Someone somewhere is mourning this person's death. It's sad that it happened the way it did. I hear people at work (I work in a hospital) say things like that about motorcycle riders all the time. They call them organ donors and other similar names. I don't agree with that either. Even a death due to poor choices whether riding too fast on a bike or shooting one's self, is sad to me.

The SO has someone she was rather close with do something like this. Was playing a 'trick' of some sort that was supposed to make the weapon not fire but discharged into his stomach, killing him. It's tragic no doubt but I certainly offended several people when I met people she knew because I didn't show adequate sympathy. Don't misunderstand me, I was certainly not making light of the situation as both it and this case was an incredibly sad one, but to be exalted as a hero I didn't feel was necessary.
Bad things happen to good people, especially if they have a moment of poor judgement. RIP.

i thought you were suppose to treat a gun like it was loaded even when it isnt just incase??
I guess im just a little callous(sp?). IMO death by stupidity is just worthy of
Anklebiter- poor judgement(riding a fast bike) is alot different then pure stupidity(playing with a gun)
I agree that it is an easily preventable death. It seems you see about as many people treat a gun like it is always loaded about as often as you see people wearing a helmet, I find both situations almost equally concerning. And I also see several startling simlarities between playing with a loaded gun and a bike, I have to agree with AB on that.
I certainly feel empathy for both of the families and friends of these young men, and even some sympathy as they havesadly lost someone they cared for and loved, but as far as the young men are concerned with me it is something that happened that should not have and needs to be left at that.
I don't find it completely coincidental that in both my story and this one that the BAC was roughly the same.
