According to the lawsuit,
Chabot pulled over a van operated by Carlos A. Tamup because Tamup had failed to use his turn signal when changing lanes.
The lawsuit alleges that Chabot first confirmed that Tamup’s license and registration were valid
and that he had no criminal record.
“Chabot nonetheless proceeded to open the doors of the vehicle, and by utilizing Tamup as a translator,
requested all the passengers to also provide identification,”
according to an ACLU synopsis of the case. When some failed to do so,
Chabot then asked them to produce documents “demonstrating their U.S. citizenship.”
When none of the 14 were able to do so, Chabot advised them that they would all be escorted to the federal Office of Immigration and Customs Enforcement in Providence.
Then, the lawsuit states, Chabot instructed Tamup, the driver, that he was responsible for the vehicle’s passengers, and that if any passenger attempted to escape from the van en route to Providence, that passenger would be “shot.”
The state police response to the first complaint “expressed complete satisfaction with the way the stop and detention occurred, which led to this lawsuit,” said Brow

Unfortunately its pretty obvious that this is a frivolous idea by the ACLU
I like what they do for people but I dont like the petty actions like this.
It should be fairly obvious if you have a van full of people that dont have documentation that they are illegal and therefore breaking the law.
If youre stopped in a car that someone else is driving you are subject to being required to provide identification.

Unless you have a State issued Driver's License or ID Card...you don't have to provide ID on demand...
Most States, written in the law, is the "implied consent" that you must present it when requested by any "authority"...read the terms of the License...it might even be written on the license itself...
But there is no law that says you are required to carry "papers" on you...
However, The "authority" does have the power/authority to "detain" you until your identity can be ascertained...

My brother took some French friends to Big Bend national park, which is close to the border. They all had their passports with them, but he didn't because come on, do you carry proof that you can be in this country with you?
Anyway, being so close to the mexican border they got stopped by the border patrol (they never left the US). Since my brother was in a car with foreigners and didn't have his green card with him, by your logic he's obviously illegal.
ask anybody from a country that had these stupid paper laws and random checkpoints and they'll tell you why they got the fuck out of that shit hole.

The ACLU has gone far FAR beyond any reasonability IMNSHO and I for one would rather not have them around at all if they continue doing what they've been doing.

Going by the information presented, the police operated in a rather piss poor manner, and I think the ACLU has a case. Unless the officer recognized one of the foreigners as a wanted criminal, he had, in my mind, no right to demand identification from any of them. He was committing racial profiling, as the ACLU claims.

I still don't understand how someone whom is not even a "legal" citizen has any civil rights under the United States. Hell, they can't vote, and what about taxes. They are criminals, from the get go. They need to follow the same rules we have to. There's right and wrong. They choose wrong.

Our state requires someone to posses IDENTIFICATION, it's a law.

if someone doesn't respect the laws of this country enough to try and get in the legal way then (in my opinion) i don't believe they have the right (besides human) to use those laws against us. like ronald reagan(sp?) said" trust only with verification." besides, most legals in this country have to go through english classes in order to even be considered for citizenship! that should throw up a red flag right there!

My ancestors, along with every other American (except Native) had to go through the legal process, and how quick politicians are to forget that. Perhaps it's because most of them are able to keep their children and other family out of harms way in defending this Country. WE THE PEOPLE... have to go through the process. I had to take a driver's test to get my license, what about you? Do they... most of them no. I've seen them laughing after hitting someone, and laughed harder when asked for license and insurance. I feel no remorse of the illegal immigrants that come here ILLEGALLY. Especially those that just want to sit around and stay drunk, already living off Medicare and Government Housing. Hell... we had enough problems of that from legal citizens, now them too. Will it ever stop.
