People tend to think courts are the way to go, the sad truth is that even if you win, it doesn't mean you are going to get your money. Unless the court is willing to garnish wages or seize assets you are pretty much out of luck. And assets can be hidden and jobs can be changed. I have a family member who is a landlord, he has yet to see a dime of any judgment he won against delinquent tenants who failed to make rent or damaged the property in the 10 years he has been a landlord. To him it's a waste of money to even take these people to court as it costs him more than he would ever hope to see.
Bottom line is that courts are useless for getting recouping your costs, they are useful in getting someone evicted.
you are right, it isn't a guarantee that they'll get their money but at least there is a court order stating that a certain party owes money to another certain party.
People are too young here or not thinking. Why do anything to him to make him stop paying rent? That would be a stupid move, I would rather not have him pay for Utilities then have him just say F you and stop paying rent.
Would you rather be out xxx amount for Utilities or XXXX for rent plus Utilities. Going to court even small claims takes TIME, MONEY, and if rent is not paid could add up more then small claims allows.
i am thinking more of principle on this one. his roommate is abusing his other roommates with this, it is just plain wrong. he can stop paying rent sure, but that only strengthens the case against him b/c his name is on the lease.
figure out what he enjoys most while he's at the apartment...like internet, watching tv, taking a shower, wacking off..
whatever it might be, and then you take it away from him...
say he watched a lot of tv, cut off the tv for a while, if he likes wacking off, go pawn all his porn collection, if he takes a lot of showers, turn the gas or electricity to the water heater off
its really quite simple...if he wants to use it, he has to pay for it

If i tried to talk to him, and it didn't work. Heres what i would do. I would go get a bunch of beer and get him really plastered. Then beat the living shit outa him. Or i would get one of my other friends to jump him. But i live with some of my best friends, and we all lived in a dorm together so i know they are good for it.
Chain and padlock on the fridge, you and the good roomate get the only keys. Heavy duty (front door type) locks on the bathroom, again just you guys get the key. Use the "parental controls" on the TV to disable every single chanel. On garbage day empty his shit out of the can while he is at work and dump it on his bed. If he doesnt pay for electricity, water, or garbage he doesnt get those services, period.

MY roommate 6' 140lbs,
me 6' 245 lbs, i bench 305... i'm very intimidating standing next to him...
he gave me a check for $6.50 today with a "deposits" claim on that..
i am handing him another "adjusted bill" because he didnt put down a deposit for comcast the dumb fuck...
if he kept accurate records like me he would know he deposited on the utilities and electric....
and he'd know that he wasnt working with a $130 credit, it's $107...
and he wants to do other people's finances?! i'd be afraid...
If he's a finance major, then he's probably not much of a handyman, therefore -
1. Throw the main, then take the sockets in his room and in the living room and unscrew the wires; put wire nuts over the bare ends to prevent fire and replace the sockets. No more power for him for plug-ins (tv, comp, stereo, etc). Tell him you've put in a call to the landlord to have the problem looked at by an electrician. Let the landlord know what you've done and why.
2. Locate the water heater and valve out the hot water. Teach your other roommate how to turn it back on when she needs to shower. Shower when the bum is not at home.
3. Cut the cable service. You can live without it.
4. Cut the phone service. You probably have your own cell phone anyway.
5. Assuming you're in college, you have access to the internet at school. Cut the internet service.
6. Cut the gas service or valve out the line. Put oil radiators in yours and your roommates' bedrooms to keep them warm.
These are the things I would do if I were in your situation.

it all depends on your state i would imagine. look into, but i would think most judges would see your side of it.
as long as he keeps "forgetting" to pay his bills, why dont you dump the trash can over onto his bed, just to "fuck with him". screw stealing shit from him, cuz that can get you into trouble. but i doubt you would get arrested for vandalizing your own house. what a douche bag.....
You can kick him out, since his name is not on the lease he has no ties to the appt. If he refuses to leave you could call the police and they would make him leave. Legally if you want him to leave he has to because he is not on the lease.
It doesn't work like that.

I moved into my apartment in august with my two roommates, everything was great but because i was the only one with credit i had the bills put into my name. We are all on the lease but i'm the only one with the bills in my name. So thinking that my one roommate was on the up and up i went ahead and was like everyone pay me and i'll pay the bills. Well months later down the road he decided he doesnt like the way i "act" so in order to "fuck with me (his words)" he's not going to pay his portion of the bills. i suppose that he though i needed his portion (i dont i'm smart enough to save to cover everyone's ass in the house).
My question is if this behavior continues do i have a legal leg to stand on? Say i wanted to take him to court to get the money he owes me? I've heard that i dont because nothing was put into writing but i've also heard because there was an oral agreement made between us 3 and he is failing to hold up his end that i do have one.

You can do several things on this. Taken his stuff won't help you like some mentioned. These accumilated bills are civil issue. Property on the other hand is criminal, and he could press criminal charges against you for theft.
1) You could go and speak to the landlord and advise them of you situation. They might even move you into another apartment by yourself, and you could find responsible roommates to assist. Especially since you've paid up your part upfront, they may be inclined to assist you. With all of you on the lease there's not much you can do there. Now... with all the bills in your name, you can go and have those turned off/ or cancelled. Thus, if they wanted anything, they would have to get it done in their name. Even the electricity. Perhaps then they would move out, and "abandon" their part of the lease due to the uncomforties. You could date this and present it to the landlord as their abandonment of the propery, and also to the police.
It most accounts though, I'd say you're screwed. Financially, it would probably be best you cut your losses and move to another apartment, though you would loose the money you've already deposited, just notify the landlord of what is going on. Just remember.... YOU can sue anyone for anything, wether or not you''ll win is another story.

I'm not saying everyones ideas are not good...LOL Most of them are down right funny. But is it worth risking him just saying F you and walking out and not paying rent? Because I know that is what I would do...and then when you take himt o court and he has proof you dumped shit on his bed and locked him off of this or that the Judge might actually say YOU forced him not to pay and leave.
How much in Utilities are we talking? Maybe tell the other roommate that you now need to split them 2-ways instead of three because "Dickhole" over here is not paying. It might make that roommate take action too against the dickhole.
As far as I might go is to cancel what you do not need. You do not need TV, rent movies. You do not need High speed internet or a land line..nix those services. Real drastic cancel all utilities and get ahotel room, I guarantee one of the roommates will get them put in their name...LOL
