3101 miles on my new bike.....
totaled!! two lane road, im behind a car with 2-3 car length between us. heavy traffic just opens up and she's not paying attention and locks 'em up to avoid a rear end collision. she fish tails and i see she is either going to hit the car ahead or go left and hit the gaurd rail. my first instict is look to see if i can change lanes and go around. i didnt want to stop in fear of cars behind me not seeing whats happening and rear-end me. so i have room to change lanes and do so. by the time i get my eyes going forward, she is now going right, and t-bones me on the left side and down i go. i dont know how my left foot is still attached? im ok knees have some nickle size scrapes, my anckles are slightly sprained my knee and shoulder are not feeling too good, and plenty of bruises . i would guess without my jacket with protective padding i would have some broken parts. every thing i was wearing is damaged.
her insurance company has been pussy-foot'n me around. they may not cover the loan on the bike, draggen thier feet about medical. i told AAA all i want is for things to be the same as they were before i was hit. new bike and gear , no money out of pocket. i called a lawyer lastnight and waiting for a return call. i didnt want to go this route but the insurance company is leaving me no choice. not to mention ive been all stressed out about everything. thank god im alive and pretty ok.

Damn man. That sucks! Glad to hear you're okay for the most part!
I don't get insurance companies. They always seem to try to get out of payments. They get paid to provide protection(insurance) to the customer, yet when the customer needs them they are all too often not willing to help easily.
Hope everything gets straightened out for you and if you're stuck getting a lawyer make sure you get his fee included in the suit.

Damn sorry to hear that. Won't go into accident avoidance as I wasn't there.
Your insurance company should take care of things (less your deductible) and go after her insurance assuming you had full coverage and she was at fault. They'll get reimbursed for what they pay plus your deductible. Call your agent.

piss's me off that things can't go as they should with insurance. now i have to come up with $500 for my deductable. given the economy and christmas , $ 500 is hard to come by. to top it all off the insurance company will only cover the bike for what it is worth, not for what i owe. i figure about $1000 short. so now im appox. $1500 to get out of the old bike and i also need a down payment for a new bike and an "08 is more expensive. i dont understand how someone hits me and im out money, and maybe a bike. this is why i thought a lawyer might help.
yeh ray i have been beating myself up all week trying to figure out how i could have avoided the accident. i think i did the right thing, i happens so fast and i think it was wierd how she changed directions so fast and didnt stop when she could have. it was almost like she was trying to get off the road, and didnt see me. maybe i could have "gun'd" it past her, things just happen so fast. i am mad at myself for sure, if im going to be a "biker" i better learn to react better , i guess. if thing dont go my way i may not be a "biker", who knows? needless to say; im mad at the world, and thankfull im ok and alive.

you can make up the difference in pain and suffering... just a hint. run up the specials a bit, get a few x-rays, chiropactic, physical therapy... etc... P&S should be 3x's the medical specials (medical charges)... this is the range most insurance companies will settle to avoid bad faith claims. you may not get quite that, but you should get close.

+1 Sorry it happened, BUT document EVERYTHING with as much info is possible. Insurance companies looking at haveing to pay a claim look for anyway to cut their loses. Good luck and for those looking to finance a bike take the gap insurance the 7-10 dollars a month will pay off in an istance like this.

document how many days you had to avoid activity, mornings you woke up in pain, back pain, joint pain, etc...

Good Luck in being compensated for your loss. I know I would hate to be in your situation right now so I definitely feel for you.
I remember when you first started posting up in new riders this summer. It seems like you already are in the market for your next bike, so I'm glad to hear that this accident hasn't strayed you away from the sport...
...And I want to say this in advance before some smartass comes on to blast you. From what I have read and if read correctly, it doesn't seem like this accident has anything to do with being on a big bike as the first bike. I know a lot of people will try to use this thread to prove that point, but from what I've read it doesn't look to be that. To a point all accidents can be avoided (taught in MSF)...but it's an accident.

i appreciate your observation on the fact the accedent didnt occure due to the bike size. it was strange how the acceden happened, but im sure there was a better way out. lack of experence comes to play.

I am sorry about your accident and good to see you are ok. However, this is protocol. Insurance companies only pay for what the vehicle/bike is worth. That is why you buy GAP to cover the difference. You have to think about it for a second in this case. Say someone made a stupid purchase and had to roll an extra 6k onto the price of a new bike being they may be upside down. Why should insurance companies pay for that?

If another is at fault YOU do not need GAP to be "whole" If the other party is at fault THEY'their insurance is on the hook.

Insurance pays to fix a vehicle or the current value if totaled not what you might owe.
