Not exactly what I meant. When I lived in Tennessee, I owned several NFA firearms. For a private citizen, owning a machinepistol is 100% outlawed in California, as is owning a simple semi-auto AR15.
You are afforded special privileges as a cop that others are not -- whereas I can exercise those same actions outside of California. That is a freedom lost. I don't have to be trusted by the state to own those firearms.
(FYI: I am a "Second Amendment Absolutist". I do not believe that an adult who is law abiding should have any impediment to owning any firearm)

(Re: Giving cops the presumption) Some courts do some courts don't. Depends on the Judge. You know that.

As a general rule, the courts are required to. That's why in traffic court when it is your word vs. the cop, the cop always wins.

It would be horrible (not to mention the end of my career and homeownership) to shoot an innocent person. I don't know anyone that would want to do that. On the other hand it's pretty easy to not get shot by the cops. Do what you are told now, bitch about it later (and maybe get a big payoff). Not every "innocent" guy you see shot is indeed innocent. I have a great story right now but you will have to wait until the trial is over.
|
I agree it must be horrible for you, but here in NYC, we've had cops jailed for ramming a broomstick up a guy's ass. NY has one of the highest proportion of jailed cops, and not to mention that NYPD has one of the worst reputations among other LE agencies (Story: Post Katrina, a convoy of NYPD vehicles speeding through Virginia in excess of 90 MPH is stopped and ticketed by VA state troopers, and their chief almost arrested for refusing to pull over).

Every judge I have ever met here in CA is a lawyer. Even the elected ones (like my brother). And he was appointed and then has to be re-elected every 6 years. No one runs against you unless you are a complete idiot.
|
Like I said, it's different everywhere. In some places, judges are appointed by the gov or mayor.

You know what? The majority of people that get caught doing illegal stuff? Guilty. I'm not talking vehicle code stuff. I'm talking real crime. Robberies, burglaries, assaults, etc. Funny thing is they all say they didn't do anything. Sometimes I am involved in an arrest and see the actual crime scene and talk to the suspect and later read about it in the paper and can't believe the spin and the lies by the lawyers that get this guy off.
|
I hear and believe you, but the problem is when someone who
is innocent gets trapped in the gears, or (as in my story earlier) one cop decides he has an axe to grind with a non-cop. Unfortunately, most LE agencies are geared to assume you are guilty and treat you as such -- which is constitutionally problematic to say the least.

As a citizen it sickens me that you can dupe the system to the point that the guy is right back on the street doing the same thing. This whole process we have is messed up. I just try to do my best to make things better for people even if all I can do is one good thing per shift.
|
That's the right attitude, but you have to remember that justice requires that the state prove it's case. If it can't, then the accused gets off.
But take heart in knowing that even when people get off, they usually get busted again and it usually sticks the second time around -- that doesn't help murder and rape victims, but that is the best thing going.

And concerning the dml. I didn't break a rule to get banned. I had a lawyer that can't read well misinterpret a PM.
|
No, you did break a rule. You broke the unwritten rule of not stepping on a GodMod's toes and not kowtowing and yassamassa'ing when one of them speaks to you.

It was still in the box? Huh! I'd like to read the whole story.
I will say that I will gladly sit in an OC jail for a month or two for a multi-million dollar settlement.

It was in Costa Mesa, but I don't know what jail house. Part of the lawsuit was due to the fact that he got beaten up in jail by other inmates.
I wouldn't sit in any jail for a month or two (except in Mayberry). No money is worth getting that abuse, or being forcibly married to some guy.

water under the bridge. Just think if the dml would let people talk things through. They might learn something and maybe think a little bit more about the other side of things in the future. I know I will.

yeah. ebony and ivory.
but not when the Suede-Denim Secret Police run things.
