Not exactly what I meant. When I lived in Tennessee, I owned several NFA firearms. For a private citizen, owning a machinepistol is 100% outlawed in California, as is owning a simple semi-auto AR15.

You are afforded special privileges as a cop that others are not -- whereas I can exercise those same actions outside of California. That is a freedom lost. I don't have to be trusted by the state to own those firearms.

(FYI: I am a "Second Amendment Absolutist". I do not believe that an adult who is law abiding should have any impediment to owning any firearm)

As a general rule, the courts are required to. That's why in traffic court when it is your word vs. the cop, the cop always wins.

I agree it must be horrible for you, but here in NYC, we've had cops jailed for ramming a broomstick up a guy's ass. NY has one of the highest proportion of jailed cops, and not to mention that NYPD has one of the worst reputations among other LE agencies (Story: Post Katrina, a convoy of NYPD vehicles speeding through Virginia in excess of 90 MPH is stopped and ticketed by VA state troopers, and their chief almost arrested for refusing to pull over).

I hear and believe you, but the problem is when someone who is innocent gets trapped in the gears, or (as in my story earlier) one cop decides he has an axe to grind with a non-cop. Unfortunately, most LE agencies are geared to assume you are guilty and treat you as such -- which is constitutionally problematic to say the least.

That's the right attitude, but you have to remember that justice requires that the state prove it's case. If it can't, then the accused gets off.

It was in Costa Mesa, but I don't know what jail house. Part of the lawsuit was due to the fact that he got beaten up in jail by other inmates.

But still, these judges that are appointed must be lawyers except for in VERY rare circumstances almost always involving rural areas. In any case with any real weight, the judge WILL be a lawyer. How else could he possible rule on matters of law if he/she were not educated in such? You will NEVER find a judge in LA, OC, NY, ANY metropolitan city who is not a lawyer.

I just mentioned that as a sidebar, and also mentioned that it varies widely.

Plenty of places have judges elected who are not attorneys, for instance.

Some states where the bar has a heavy hand in legislation (i.e. NY) then you don't see appointed judges who are outside of thelegal profession.
