so my daughter's soon to be husband went into the marines. he supposedly signed a waiver to have his truck payment put on hold until he got out of basic. the recruiter didn't really explain things to them. I know they should've known what was going on but they're just 2 young kids (19 & 20) with no experience. now their truck is on a repo list and the the recriuter won't return her calls. she's also having a hard time with the finance place because everything is in his name.
I guess my question is.....what does she do now? is there someone else she can talk to to get help with all this?
when her Dad was in I was young and played stupid. I'd go straight to the commander to ask things and pretend I didn't know about the chain of command. lol

Does HE know about this? If not he needs to and then go to his CO. I have never been in the military but most of my friends have and I asked them about the "hold payment" they didn't know anything about it but they have not been in basic for very long time so things may have changed.

who has a copy of the signed waiver? if the recruiter gave it to him, then he/she may have retained a copy in the enlistment package. get a copy of that waiver and present it to the lien holder.
if no one can find a copy of the waiver, then the recruiter should know how to get in touch with your daughter's fiancee's co at basic.
where is he in basic at, south carolina or san diego?

he's in san diego and she has yet to talk to him just letters. I just don't want them losing their vehicle over something stupid. she doesn't have a copy or I would've already taken care of it.

You have to get hold of the recruiter and get a copy of his paperwork that shows when he went to boot camp. Then, call the creditors and provide a copy to them if asked, but ask for deferred payment due to armed forces basic training. I have personally done this and it can happen. If the person you talk to can't do it, request to go higher in the management chain.
It will also help to have the recruiter do up a letter stating the dates for basic training. A copy of this letter should be provided to creditors.
This should all have been done before he left to go to boot camp, but it is not too late for it now.
You may have to see about getting a Power of Attorney signed by him in order to get this done.

Isn't this a voluntary action by the creditor? From my understanding you can put in a request and see what they can do, but the majority of the time the payments are still your responsibility.
While I was in AF basic training (May 2006 - July 2006) my truck payments and bills had to be taken care of by my parents (power of attorney) and my bank's online bill payment system. I did inquire about the SCRA, but they couldn't do anything about putting my bills on hold for any period of time.
It's true, it's up to the creditor whether or not they're willing to hold payments due to boot camp or during long deployments, however, it's usually just easier to setup automatic payments or have a POA made up for a trusted person to take care of financial issues while you're away. Navy Relief Society sometimes helps with those kinds of things as well but they're more of a pain in the ass to get help from anyways, you have to go through your command and whatever. As far as the recruiter not getting back to her, that's just bad business and it shows a lot about his character, I hope that's not a Marine you're talking about, I'd have his ass. Anyways, it's easy to go above soldiers like that, just contact his command and it'll get taken care of faster then you can say "thanks".
I just go back from a 7 month deployment in Iraq and I did request a payment hold with Americredit, however, they wouldn't even give me an interest reduction, which is the more commonly received benefit. Most creditors are just crooks so I wouldn't hold your breath on that issue.
Good luck with them, if they are Marines though, let me know and maybe I can get something done from my end.

You don't have to answer this, but I'm asking out of sheer curiosity. Even if you found out who this Marine recruiter was (assuming its a Marine) what could be done on your end? Because it would just make me think that my old BMT TI could come back and haunt me years later if I did something dumb
Just getting ahold of the recruiter and bringing the issue up, it'd hardly go unheard of if another Marine was to bring it to his attention, if need be, there's always a chain of command that I can go up as well. Honor, Courage and Commitment, that's what we're all about anyways, and that means even when it's not in the direct line of duty as well. Being civilized and following up is one of those things that we want to uphold a tradition of being more than the average person, Marines like this bring our status down more than anything else. You know that Non-Judicial Punishment or Article 134 is a "general" punishment that doesn't even have to fall under a certain category. Not saying that this is rights for NJP or any other type of legal action, but it's what governs us.
he shoulda gave his wife a power of attorney and he still has money going into an acct while he is in basic. Navy Marine Corps Relief Society..whoever forgot the name..
