SPANGDAHLEM AIR BASE, Germany — A Spangdahlem-based airman was sentenced Monday to four months confinement for her part in a sexual act with two other airmen.
Airman 1st Class Ashley N. Rains pleaded guilty at a court-martial to two indecent acts charges.
She had faced rape and sodomy charges but admitted to the lesser charges as part of a plea deal.
Judge (Col.) Gordon Hammock also sentenced Rains, 22, an aircrew life support specialist with the 22nd Fighter Squadron, to reduction to the lowest pay grade.
She faced a maximum sentence that included as many as 10 years in a military prison, but Air Force prosecutors argued for a lighter sentence of two years.
The alcohol-induced menage a trois on Sept. 24 in Bitburg included a male airman and a female staff sergeant.
But both prosecution and defense lawyers debated whether it was consensual among the three.
Rains and Airman Christopher D. Hicks are the only airmen charged in the incident because the Air Force lawyers said the staff sergeant was too drunk to give consent.
Air Force prosecutor Capt. Mike Felsen said the staff sergeant “appeared drunk” and slipped “in and out of consciousness” while Rains and Hicks performed sexual acts with her.
Felsen argued the staff sergeant, who did not testify during the trial, was vulnerable and Rains and Hicks took advantage of her.
But Rains’ defense attorney, Capt. Matthew King, called the incident a situation involving three consenting adults with “various degrees of intoxication.”
King argued that Rains shouldn’t go to jail for what amounts to a drunken threesome.
“Does she really have to go to jail for this?” he asked.
The Air Force had charged Rains with rape and sodomy, but prosecutors could not prove the more serious charges, King added, therefore, the question of consent isn’t relevant in Rains’ case.
Rains said she was embarrassed by the episode.
“I’ve learned from this mistake,” she said during a statement she read at the trial.
Hicks faces more serious charges.
The airman, who is assigned to the 52nd Civil Engineer Squadron, has been charged with rape and sodomy and will face a court-martial at Spangdahlem Air Base on May 30.
omfg. if it was'nt a consenting act then throw the book at both of them. but if it was, then i don't see why the "
powers that be" would want to intervine.(sp?)
the military is having to many problems getting people sign up so why
go through the trouble to act that SEEMS to be consenting?
edit: i guess we'll have to wait to hear from the third person to make any kind of decision on this one.

Last time I checked the military(as a whole) isn't having a hard time signing folks up...and I did a TDY working with a recruiter some months back(AF). WIth that said, the issue with recruiting isn't just finding guys/gals to sign up...it's finding QUALITY folks(read: not fat, intelligent, motivated, no arrests, drug free). Alot of my generation can't meet those standards thus we have a smaller area to pool recruits from. Whatever the case, we have standards and rules(read: UCMJ) that if not followed you can/should get busted for. I wouldn't put up with that crap from one of my troops and my boss would put up with that shit from me.

I was wondering the same thing!!! During my active duty time it was rare that I came across an Airforce girl that wasn't hot!! Now the Army is a different story.

The last sentence in the article says that the Airman (the Guy) has also been charged with rape/sodomy. So he is not off the hook yet either. SSG must be playing the "I was too drunk to know what I was doing" card...

The word got out and she was embarrassed, cried rape and now 2 other ppl are getting punished...IMO
Lets see, there is Article 125-Sodomy, Article 120-Rape and Carnal Knowledge, and then the wonderful "Catch All" Article 134(ART. 134. GENERAL ARTICLE - Though not specifically mentioned in this chapter, all disorders and neglects to the prejudice of good order and discipline in the armed forces, all conduct of a nature to bring discredit upon the armed forces, and crimes and offenses not capital, of which persons subject to this chapter may be guilty, shall be taken cognizance of by a general, special or summary court-martial, according to the nature and degree of the offense, and shall be punished at the discretion of that court.)
