Nobody thinks the car had enough damage for her injuries, even though SC law says if you hit a fragile old lady too bad for you. She has a lot of preexisting, but this really set her health back and did add a totally new back problem
The problem is going to court. Lawyer one dropped this after a year. Lawyer too doesn't seem eager. It's $4500 per doctor for taped testimony alone
So over a year now, two lawyers, we've spent I'd guess over 10k out of pocket on medical and while my Audi TT was supposedly fixed, the rear end squeaks like an sob and I can't get anyone to do anything about it
I have friends that got 5 to 10k forced on them when they were unhurt in an accident. My wife will prolly end up under the knife and with yet more chronic pain for life
It's highly likely we will never see a dime, all because she did the right thing and got the plate number

I don't recognize the logo on that jacket, the padding looks real cheezy. Get a brand-name jacket with CE approved armor. It will cost you more but what is good protection really worth? If you look around, there are a couple of places that have great prices on closeout items.

Yeah, I was like that insurance isnt paying Jack(no contact) (no Proof). I dont know why these guys were saying they should or will pay.
Your out of luck, I didnt even know the ninga 250 had strong enough brakes to do a stoppie. FyI for next time, scrub as much speed as possible , then let off the brakes and move to the side of the vehicle.

I'm trying to get everything worked out. I don't wanna say too much over the internet until everything is settled.
But I do have a question....I need a set of wheels, and I can't afford to drive my truck daily. Would it look bad if I bought another bike right away ?
I found an 03 Suzuki GSXR 600 with the paint scheme I have wanted since I was a kid. If I don't get it quick it'll be gone. But idk if it would look bad if I bought something right away.
Regarding a 250 doing a stoppie: I had to stop SO fast because the guy pulled out in front of me ALMOST as I passed the intersection. I squeezed the front brake REALLY tight to stop. If I had not grabbed so much brake I would have hit him.
This is all a mess. I just wanna ride. I haven't ridden a bike in almost a week and I am getting ancy !
My favorite time of year is now when the weather gets cold, I've been excited to ride in this weather, and now ...I can't use the bike. MANNNNNN!

Why should it look bad if you bought another bike right away? How would anyone know that your bike isn't your only transportation? If you can afford to, buy it and sell the Ninja after the dust settles if you need to.

I am not entirely sure how it works in your state, but in PA, then UIM coverage would kick in and pay for what was necessary. Did you get UM/UIM coverage? It seems like you did. Has one of your attornies discussed this issue with you? Have you put your carrier on notice of a potential UIM claim?

Glad you're ok.
Don't worry so much for the bike, it can be fixed. The other person's insurance should be paying for everything, including your hospital bills and new gear. Make sure they pay!

So just an update. Earlier last week. Around 12/04/2012 I received word from the other person's insurance that they were NOT going to cover the repairs on my bike.
The reasons are:
1. I did NOT hit the driver
2. I wasn't hurt
So basically the only option left is to either leave it alone or take it to small claims court. I'm pretty drained from this whole process. And I don't know if I want to drag it out any longer.
I brought the bike to the local shop yesterday and got a quote on repairing just the major damage.
$1215.00 that's not replacing the fairings. Which I found a set on ebay for $500
So that's where I'm at. I don't know if I would win in small claims court either because there was no contact made and I don't have a witness.
I was looking to get another bike. But I think I'm just gonna fix the 250 and keep riding it.
I think I have realized something about my riding style. I'm too conservative when I ride. I don't take enough risks.
Once I get my bike back I'm going to practice emergency braking a lot more, and weaving.
I'm also going to work on doing a stoppie too I think. The reasons for me wanting to do this is ....this is what I'm thinking..... I can get more of a feel for the bike.
I want to learn to push whatever bike I'm on to its full potential, not just to go from A to B.
any closing comments are more than welcome.

They only do crazy things like ticket someone who crashes, but hits no one else or does any property damage, basically effects no one but themselves, in VA (plus probably every other state I'm sure, I just happen to not like VA).
I mean, what would have ticketing him for failure to maintain control (A.46.2-853, RD-OP IMPROPER BRAKES-MISD in VA) have accomplished?

That is an excellent idea. You could also look into taking the advanced MSF and doing some track days to hone your skill.

Unless you are a stunter, I'd work on controlled stopping (the kind that doesn't involve a stoppie).

Take it to the track. You do that on the street and you'll end up much worse than you did this time.

Sorry, when I said I wanna learn to push the bike and emergency break and everything, i forgot to say it would be off public roads or on the track.
I definitely wanna go for a track day in the future.

I got a speeding ticket for my single vehicle motorcycle accident last year. Lost traction on some metal in the road while it was raining. Cop saw it and came over screaming at me. Wrote me up for going 50 in a 20. Got most of the fine thrown out in court, but the points still hit my license.

Yea a couple things. The foot peg and shifter are bent, and it's one piece so the whole thing is being replaced.
New windshield
Both front blinkers
Left rear blinker
Left handlebar
Both mirrors
I think that's it. But I have to pay labor also. I just wasn't up to working on the bike myself.
That's the only place I can think of in my area.
