Its hard to be reasonable when your dealing with a bunch of idiots that try to say that doing over such and such speed is only an accident. The outrageous charges if you get caught disobeying this law are there to prevent them from being broken in the first place. I think this law is going to just piss off mostly younger riders out there that buy new-used bikes and do the stupidest stuff on them for there first 1-3 years riding. Eventually the hooligans get enough tickets and mature enough to know that a law like this really isnt that bad when you dont act stupid. Dont get me wrong though older riders will still find the law a problem but its going to mainly IMO offend the younger owners of sportbikes.

Just like the 55mph speed limit on the most wide open stretch of the GSP got changed from 65 to 55 and in the first day I saw 2 accidents take place,one rather bad. It's all about the safety...

that makes sense. i know in japan they class vehicles in such a way. they also class vehicle by the experience of the driver. all of which is visible on the outside of the car.

This is just another example of an unconstitutional law that will be overturned by injunction on criminal appeal, or by civil class action, with refund of all money illegally seized. It's a violation of Constitutional Equal Protection doctrine under the 14th Amendment to have a "law" that only applies to one group of citizens, with immunity for another group of citizens. Since this "law" originally only applied to bikers and not drivers, the law had to be changed. However, it's not enough to write that a law applies equally, it must also be enforced equally. I doubt the Florida law will be enforced against drivers, but then again, cops and gangsters in govt are greedy.

The 14th Amendment is the law that supposedly freed the slaves after the Civil War. Bikers are not slaves, no matter how badly the police state wants them to be.

Police are never prosecuted for speeding with their emergency lights and sirens turned off, which are required to be turned on before they can violate any traffic law. That's also an Equal Protection defense. So the Florida law can be defeated that way too, which is how I defend myself in every ticket case, by using the cop's in-car video to prove he violated many laws.

Virginia was forced to kill it's "law" demanding drivers pay $3,000 speeding tickets, and is now refunding all that money:

The Virginia "law" for $3,000 tickets also violated Constitutional Equal Protection doctrine, since it only applied to Virginia residents. Visitors only paid the usual $10 to $150 tickets. Equal Protection means a law must apply the same to every person.

Both the Florida and Virginia laws certainly qualify as "cruel and unusual punishment", which is banned by the US Constitution and state constitutions. However, defendants are routinely "ticketed" for up to $100,000 in US courts. So the Florida law can be overturned on that issue.

California cops are now paid $200,000 salaries, while city govternments must file bankruptcy in federal court to stop payment on those contracts with police.

Most of those toll roads are owned for foreign corporations, that keep all the profit. Existing streets and highways are being given away to private corporations for toll roads. The King of Fascist Spain has already seized 7,000 miles of existing roads in Texas, for toll roads just to drive across town.

Foreign corporations are also now getting 90% to 100% of traffic ticket revenue in USA, by installing robocop spy scameras at redlights, and radar robocops on highways. Which is just another way to turn an existing road into a toll road.

I don't wish to be in a regulated enterprise. I'm not engaged in trade, commerce or industry. I don't want a driver license. I want to travel as a constitutional right, not as a state licensed privilege. But these police over here insist, that if I don't have one of these things, that they're gonna pull me over from time to time, and hurt me if I don't have one of these little pieces of paper, and I don't want to be hurt. So, under duress and threat and coercion, I put my signature on there, but I made a specific reservation of right that I'm not a party to this contract. There may be people who willingly volunteer into this, but I'm not one of them. Therefore my signature is not valid here. It was obtained under threat and duress, and I am not a licensed driver.' Sign your driver license 'WITHOUT PREJUDICE' and/or '1-207-UCC'. You know, if the people just figured out that it's all about money - if the Sheeple stopped being sheared - there would be a whole lot more wool around. We're going to make no admissions or confessions at the scene. When I get to court, all I want to testify against me is that RADAR unit. When you get to court, the first thing you're gonna do is 'deny responsibility'. It's a CIVIL matter now, NOT a criminal matter, so you DON'T 'plead guilty'.... ETC
All traffic tickets are "easy" cases to win in court, much easier to win that "real" trials. Just do your homework, and defend your Constitutionally guaranteed rights, including your right to travel without an internal passport driver license contract. 50-million illegal aliens are not required to have driver licenses nor ID in USA, especially in Florida.

This Florida House Bill 137 has NOT been passed into law. Not for bikes and not for cars.

HB137 passed in a House committee, 9 votes to 1 vote against, but has been heavily modified on March 13 (no text provided). It has not been voted on by the House Legislature.

There is no equivalent Senate Bill, which only allows temporary confiscation for reckless driving on a bike. So this House Bill can never become a law without the Senate writing a similar law and voting on it.

Florida Bill HB 137, before the all-vehicles amendment on March 13:

(1) When a law enforcement officer charges a person with reckless driving in violation of s. 316.192 or exceeding the speed limit by 30 miles per hour or more in violation of s. 316.183(2), s. 316.187, or s. 316.189 while operating or in actual physical control of a motorcycle, the officer shall arrest the person, take him or her into custody, and seize the motorcycle, which shall be subject to forfeiture under the Florida Contraband Forfeiture Act.

(2) Upon conviction, in addition to any other penalty provided by law, the court shall revoke the person's authorization and privilege to operate a motorcycle for a period of 10 years and order the person to surrender his or herdriver's license.

(a) If the person holds a Class A, Class B, or Class C driver's license, the department shall issue a replacement license, valid for the remainder of the person's unexpired license period, without the endorsement to operate a motorcycle.

(b) If the person holds a Class E driver's license that is not restricted to motorcycle operation only, the department shall issue a replacement license, valid for the remainder of the person's unexpired license period, without the authorization to operate a motorcycle.

(3) Revocation of the privilege to operate a motorcycle under this section shall not prohibit or restrict the issuance or renewal of a driver's license for purposes other than the operation of a motorcycle.

Section 2. This act shall take effect October 1, 2008.
Florida ABATE is reporting on the status of this bill, and is allegedly trying to fight it. You can bet that similar laws are secretly infiltrating all other states. Eternal vigilance is required to defend liberty.

The Florida House committee has now modified this bill on March 13, 2008 (no text provided):

On March 13, 2008, the Committee on Infrastructure favorably reported the bill with a strike-all amendment, and an amendment to the strike-all amendment. The amendment creates a new s. 316.1926, F.S., which provides that violations of s. 316.2085(2) or (3), F.S., regarding motorcycle operation, or violations of the speeding laws in s. 316.183(2), 316.187, and 316.189, F.S., in excess of 50 miles per hour over the limit, are moving violations punishable as provided in Chapter 318.

The amendment subsequently amends 318.14, F.S., to provided “tiered” penalties for violations of the newly created s. 316.1926, F.S. A first violation is subject to a fine of $1,000; a second violation is subject to a fine of $2,500 and a one-year suspension of the offender’s driver’s license; and a third violation is a third degree felony resulting in forfeiture of the vehicle and license suspension for ten years.

The amendment clarifies that both wheels must be on the ground at all times when operating a motorcycle, but it is not a violation if a wheel loses contact with the ground briefly as a result of the road’s surface or other circumstance beyond the control of the operator.
Note that "accidental" wheelies are allowed...

I remember driving on Florida toll roads with an 85 mph speed limit, and no speed traps, when gas was $1/gallon. I also remember driving on the German Autobahn at 130 mph with commuter traffic cruising at 130 mph to over 200 mph, for hours at a time, 100% legal, where gas is now $10/gallon.

What's the problem? The highway speed limits around me are 65-75 miles an hour. Do you really need to be going 95-105?

I think this new law isn't so much about the freeways, it's for the dumbass squids that do 75 in a 40 in a crowded residential area. These are the people that have ruined it for you, not the guys going fast on the interstates.
