i woulda definatly hurt him while he was in his car talkin shit to me tho, b/c at that point you are defending yourself from assault, when hes knocked out just throw some crack in his pockets and tell the cops he said he was gonna get his gun!!!

Seeing as he did not stop to exchange information I would think this would be "leaving the scene of an accident". If he tried to say in court you hit him, then the Judge would ask why he did not get out to look for damage or call the police.

Really though, if you can afford the time it'll take to get him in court, do it. Shitbags like him should be taken off the road. Driving is a privelege, not a right. People like him need to realize that.

At the very least, write the editor of your hometown paper. Get some community awareness going.

I can't believe you kept your head. Good work or you'd be up on charges and no one would believe you.

Here's the thing. What you should have done was pulled over, called 911 and reported an intentional hit and run. Which may or may not have changed the following:

What will happen? Nothing. Your word against his, he'll claim you hit him. End of story. What can you do?

This is why I want a helmet cam and a dash cam. Film changes everything.

I would press charges asap, take pics of the bike, get a statement from anyone that was with you. If he did this to you HE WILL DO IT to someone else. That person may not be as lucky as you did. If you press charges it would be up to the D.A. if they wanted to pursue it. As far as the assault charges. You wouldn't be out any money on that. The fucker that did this to you would have to shell out money for his lawyer. In turn if you sued him for damages then you would have to get a lawyer. Either way that guy would be fucked because he would have to pay court costs. Not to mention he was arrested for assault which would follow him the rest of his life and not to mention you might not be the first person he has done this to.

I was mostly confused, since i've never heard of that really happening. You squeeze me while i'm splitting, or change lanes into me, it's one thing, i've got a stock response/reaction for that. but reversing into someone at a stop light? luckily i've got enough lawyerin' friends and family who've told me to press charges. My sister was a public defender for LA County, and told me that when i press charges the following will happen:

He'll get a letter informing him of the charges
He'll have to appear in court, and he probably won't
he'll get a bench warrant, get picked up on it
he'll serve time awaiting trial, get convicted, and released having served the time awaiting trial.

but hey, a week or 2 of him sitting in county is good enough for me, as long as he's getting his bitch ass pounded by his cellmates.
