Default !$!@#$!@ Pot holes = Bent Rims! Can you claim it agains the city?

So I go down this road and they're doing alot of construction on it. They fix one then a New pot holes almost daily so anywase I hit one hardddd "F$#ING SH@! that hurt" now I got bent Rims . I heard someone mention once how they made a claim against the city and they paid for the damage.

Is this possible? If so where would you take your claim?

Thanks.

Around here if you can prove that the pot hole was not protected with a baricade and you were at least the second driver to report it (the first giving them the opportunity to fix it), they will pay a claim for new rims and tires. This also assumes that you weren't negligent in hitting it instead of avoiding it.

If it was a city street and a city crew or contractor doing the work start with the city roads department or similar for a claim form. Good luck.

Get pictures of it, THEN report it. Otherwise they'll fill it and brush you off like they did to my brother.

Any claim towards the city is difficult to win, just because you're dealing with the city. It's doable, but i dont know if its going to be worth all the trouble. Then again im not sure about Florida, im just speaking from experience here in NYC.

I did a claim with my city in 1989 for a bent rim on a POS Dodge Omni and they sent me a city check for it. Granted that was many moon ago and it was only about $100.

Like previously said get photos of the hole and wheel. My wife hit a pot hole in a construction zone on the hiway once. We contacted the construction company, sent the photos and receipt for the new wheel. A week or so later we had a check. You may need to be persistant.

Contact your insurance company and have them fight the city over it. Make sure everything is documented and you have pictures. The insurance has a bigger arm over the city then little people like us.

Depends on the city. I popped a front tire here on a utility cover that was replaced wrong. (sticking up in the road) I called the city initially just to get them to fix the road hazard and they suggested I file a claim and gave me the number to call. The process is a PITA, I had to drive the adjuster out to the spot cause she was retarded and couldn't follow exact directions. Takes forever, but they never blew me off.

Doesn't NYC hold the patent on potholes?
