If you think the insurance companies want whats fair for you, your outta your mind.
: Allstate Insurance Sucks : View Complaints - July 2006 : They tried screwin me over,until I got a lawyer also. Look into the Allstate helping hands for those who settle on first offer,boxing gloves for those who demand full payment lawsuit in which allstate was given the ultimatum by a judge to explain how they could deny legitimate damages on a claim to someone who was suing them,this would require them to hand over their claim denial policy. They settled the suit for the orginal amount and a significant amount in punitive damages. They tried saying I was at fault when a vehicle driven by their insured turned left into the SIDE(NOT FRONT) of my car,the woman stated in the police report she had her head down looking for her info from her wedding planner while talkin on the cell,she didn't see a car and made the left turn with her head still down. It was apparent from the fact of the damage to the car and how far I slid after impact I wasn't speeding and was going 7-13 mph UNDER the speed limit. Allstate first tried saying I was at fault for not avoiding the accident. The only way I coulda done that was swerve into a telephone pole and then again she turned into my side and never realized she was gonna hit me until Impact,then they tried getting me to agree to 50/50 responisbility,then 80/20 and nothing for my injuries,and 2k below low blue book/nada for my car which was mint and I had picture prior to prove it, with no money for mods done,new rims,full headers back exhaust,clutch,big brake kit,and some other mods I forget that were all done within 1000 miles of the accident. I got a lawyer,they kept pussy footing,seeking dismisals on random grounds,delaying a trial,and eventually wound up settling over 2 years later for more much more then I wanted in the first place,and had 2 cover my lawyers fees.
My friends GF was STOPPED AT A LIGHT behind the white stop line, a woman turned wide and hit her head on. Multiple witnessess,and the inusrance compay tried sayin that my friends gf shoulda avoided the accident and it was 50/50 fault.
The truth is unless it's a relatively minor incident and you are gonna be compensated properly,get a lawyer and fight if you can wait. The insurance companies are not on your side,nor are they intrested in being fair,they just want to drag it out as long as possible letting them hold onto the money and earn intrest/stock returns on it as long as possible,at the end of the day they are hoping you were 2 finacially ruined to continue the fight and are forced to settle for even less then their intial offer.

Relax people... all is as it should be in endoman's world.

Most people here are not expecting their insurance company to pay more than their coverage provides for. They're generally just expecting to get what they thought they were paying for. Maybe that's too much to ask, so we shouldn't blame the insurance companies.

MYTH: All drivers and riders are required to have insurance.

FACT: Read the fine print in your state statutes for "Financial Responsibility". There are many "exceptions" to that law.

At least 40% of US citizens are too poor to afford car or bike insurance, not counting 50-million illegal aliens. Poor folks can avoid payment of all crash damages by using their Homestead Exemption, filing an Affidavit of Indigency, and claiming "tenancy in the entirety" (if allowed in their state for marital property). In Florida, a Homestead Exemption includes their million-dollar home without a morgage. This is called being collection-proof, and applies in all civil and criminal lawsuits, and prevents payment of all traffic tickets and court costs, even when found "guilty". That's THE LAW.

Even if you have full-coverage vehicle insurance, it rarely covers actual expenses in a serious crash, which can be $100,000s more than the policy limit. So "wealthy" crash victims still must file bankrupty to survive a lawsuit for damages, no matter who is at fault, even if the insurance company pays what the policy is worth.

You have a Constitutionally guaranteed God-given Natural right to travel, according to police officer Jack McLamb. It's unconstitutional to convert a right into a privlege and demand payment of a tax, according to the US Supreme Court. That's why in every state the govt is never allowed to take your license to drive from home to work, and is always required to give a "Restricted License" after "suspending or revoking" a driver license.

Under civil contract law, no person can be "required" to sign a "voluntary" contract. Coercion and duress voids all contracts. Driver licenses and traffic tickets are contracts, just like insurance contracts. All courts require defendants to "voluntarily" sign a contract with the court to grant the judge jurisdiction (and thus waiver all Constitutional rights), or the judge lacks jurisdiction to decide the case. Just say NO.

Insurance corporations are private companies. No person can be forced to do business with a private corporation. If you own a business, can you get a law passed to force every person to do business with you?

Insurance executives are paid salaries of over $200,000 PER WEEK, per person, according to lawyer Ralph Nader on CSPAN. Warren Buffett, owner of Government Employees Insurance Corporation (GEICO) paid himself a TAX FREE personal salary of $35-Billion in 2007 ("donation to a tax-exempt foundation" that pays him a salary and unlimited living expenses). Only 5% of insurance premiums are paid to crash victims, according ex insurance salesman George Gordon.

Insurance companies like Travelers and Aetna refuse to pay crash victims, and instead refund all their previous premiums for the year, as if the contract never existed.

Insurance companies were founded as Mafia extortion rackets in the Middle Ages in Europe. Today, "insurance reserve fraud" is rampant with mafia-run companies, resulting in countless murders of employees to claim secret insurance policies the victims never signed contracts for. Walmart was busted for cashing secret death insurance policies on its employees, without paying the families. Arsons for insurance fraud are routinely pre-approved by fire departments, police departments, insurance companies and banksters.

One day in a critical care unit in a hospital costs $10,000. Broken legs routinely cost $100,000 in medical bills, not counting lost income or loss of vehicle. Severe roadrash can cost over $500,000 in a medical burn unit. Surgeons are paid salaries over $500,000 per year.

Poor patients get "free" treatment by filing bankrupty and claiming their Homestead Exemptions. Government "medical insurance" scams pay the doctors less than what it costs to do the work, so they lose money on those patients. Now he wants to be governor of TN, in charge of looting TennCare govt medical insurance programs, then run for president of USA. Just like the current governor of TN Phil Bredeson, who is a medical insurance executive that denies medical treatment to TennCare patients, who hates bikers at Deals Gap. Dr CanniBill Frist is a heart transplant surgeon, who loves cutting beating hearts out of living people, like an Aztex human sacrifice. Frist was busted in college for adopting dogs at animal shelters to kill them and chop them into little pieces.

The best medical insurance is wearing full CE body armor and leathers, while adding the latest upgrades. Riding schools and racing schools are also cheap medical insurance, since 95% of crashes are due not knowing what countersteering is, according to the government's Hurt Report. All 2-wheeled motorcycles must be steered in the opposite direction in order to lean and begin to turn, but in an emergency most riders try to steer like a car, which makes it impossible to turn.

All motorcycle rider license tests censor the word "countersteering", and show pictures of motorcycles steering like cars and trikes. The most dangerous part of a crash is the hospital, where 2.5-million US citizens are murdered every year.

Sorry, I disagree with some of your main points.
Myth 1 about your policy not covering all your medical bills.
Real answer. You buy and pay for a policy that states clearly $2000 of medical coverage. Now you wonder why it doesn't pay $100,000 for all your bills. This is not a bad policy. You got what you paid for.

Myth 2 Nasty thing call subrogation where your health insurance company gets back what they paid for ALL your medical from the responcible party.
Real answer. You sue the responcible party and get all your medical and pain and suffering, maybe loss of wages as well. Of course you don't get to keep the medical reimbursement. You didn't even pay it. The health insurance company did and they or you have the right to sue for it back. You mention double dipping later in the article. Getting paid for medical you didn't pay for is certainly double dipping. When you sue the responcible party you should know up front (and certainly your attorney know) that the medical part is a wash, goes back to the company that paid it. You are really suing for your damages. And what are those? Payment of med bill...no. Pain and suffering...yes. Lost wages...yes. Punitive damages to in effect fine the person (if available?)...maybe. The problem developes when you get all the money thinking it is yours. Then you have to turn around and reimburse the insurance company. In reality this is IMHO stupidity on the attorneys fault. It was never your money in the first place. The Walmart case in the news is an example of this same thing. The injured person wants to keep all the money from the settlement even though they didn't pay any of the medical bills.\

As for complaining about what you are paying premiums for...there is no subrogation of money from a responcible party in any claim for disease or accidental injury. That is why when you go to the hospital they ask if this was from a car accident or while you were at work. They want to be reimbursed by another responicble person or perhaps the employers work comp insurance. If this reimbursement didn't take place, you can bet our health insurance costs would substancially increase above the astronomical level it is currently at.

The point is we are IMHO, getting what we pay for. There is no scum sucking company ripping off anyone. In fact, again, the only rip off is trying to be reinbursed for medical bills you never paid.

More disagreement with the article.
Regarding Uninsured Motorist Coverage. At least here in California, the coverage is actually Uninsured/under insured motorist coverage. This mean you can easily cover yourself for any amount you wish. How about $500,000.

Now when the other guy hits you and has only $15,000 of coverage...you simply claim for up to $500,000 on your own policy. This is what the policy is for. You are not limited by his coverage...in CA. All your trouble are over. All your medical, pain and suffering etc can be covered.

In fairness to the sticky post, uninsured motorist (UM) is coverage you buy, but at time of claim, your company assigns an adjuster as though the coverage was the other guys. Then your company adjuster fights against the other guys adjuster for the medical. EVERYONE highers an attorney at this point to represent themselves against the "other guys coverage" (your UM coverage) You and your attorney are now, fighting it out if you will, with your own company. You win lose or come away with some sort of settlement based on the merits of your case. If you can prove your loss and future loss then you get lots of money..."Larry Parker got me 1.2 million" For you younger guys this is a quote from a TV commercial for attorney Parker.

Which is why only idiots ride without full coverage that includes uninsured motorist coverage up to at least $250,000.

Wrong. Under the law of every state, the moment you use the public roads, you are deemed to have consented to service of process. The Secretary of State in each state is your agent for service of process. No court needs your signature to have jurisdiction over matters arising out of traffic incidents on its own roads.

Wow, I just got a bike, and now I want to sell it. This is enough to keep away many beginners! Kinda sad to know that despite everything you do to be safe, stupid things happen. That's why I pray before every ride.
