I just got a speeding ticket claiming 58 on a 40. The road is a busy 5 lane highway. I am sure I was not going over 55. I thought I was just going to get a warning but he kept on commenting on how fast my bike looked. This is my first ticket ever. This happened 4 miles from my house. What is the best way to defend this in court?. How much can this screw my driving record? .
dig through the yellow pages and find a local lawyer that specializes in traffic tickets. mine usually charge $200 per. i've only had 1 stick after i took it to court and that was because i admited my speed to the officer. lesson learned there. its cheaper in the long run to pay the $200 to keep your record clean.
Fight it dont let the popo win. Go to court at least you should be able to work it out to have to take a class so you dont get any points. Just a little advise dress nice when you go , no jeans and tee shirts, nice shirt and tie. Look like a respectable person.
Did the cop say if he clocked you on radar/laser or where you paced? If you were paced those are normally easier to win, if a device was used, and you don't want to spend all the money on a lawyer. The best advice I can give is to take it to court if for no other reason then to try and get the points knocked off for insurance reasons. I didn't notice the state you were from, but you may want to look at driving schools. Some offer it online, according to recent threads, but most ( i think) you are going to have to attend.

How fast your bike 'looked?' Typical... Don't let the man keep another brotha down, haha. Seriously though, go to court, it's worth it if your story is legitimate.

I wish it were like that in NYC. Here in Staten Island your guilty once you get the ticket literaly and they will try and ticket you for anything. We also have an extremely disproportinate number of tickets issued per 1000 liscenced drivers meaning most (not all)cops just are itchin to give you a slew of charges to defend.Maybe this taken from the local paper will show you why i have an intial distrust of cops and am goin tap, tap, tap when one tries getting behind me on the highway.http://www.thehelparchive.com/new-2256561-268.html Here it is you get the ticket and if cop shows you are convicted. One judge here has an over 90% conviction rate with the rest acounted for cops not showing up and retardedly written tickets. I would love to have compasionate cops and a judge who will just take a check instead of makin my insurance company rich. There is no traffic school here the points go on your insurance even if you take a course after the ticket to reduce the points on your liscence. You guyss are lucky.
One ticket is not the end of the world, Just Go to traffic school if you have that option Or fight it Either way it's going to cost. It's all about money.
The local code enforcement has been giving me parking tickets for my car, parked on private property. It currently stands at 6 wins for me 0 wins for them. Paid a total of fifteen dollars total in fines so far. Two more to deal with next week. It's pretty bad when you get one in the mail & one taped on the car on the same day. If I had the money I would be filing a big hassasment lawsuit
After looking at the georgia DOT website, it looks like 6 glorious hours of traffic school are on the cards for me, unless I can convince the judge to drop 3 miles of the ticket, then is zero points. But I have the feeling that the city of Lilburn (small suburb outside of Atl) really wants my ca$h.
My name is Mike and I'm here to help.--- That's the line they teach us in the academy. I am actually one of the "traffic" assholes in our police department.
Coupleof things:
1. Go to court. They can't add anything on if you show up. And you get to discuss options with the judge who can make "modifications" to the penalty, as opposed to the clerk who has to impose the penalty stated in a bail schedule/penalty manual.
2. A "busy 5 lane highway" with a 40 MPH speed limit??? Sounds like a speed trap. Find out if GA has "absolute speed limits" and if a "valid traffic and engineering survey" is required to lower the speed limits below them. In CA a 2-lane undivided highway has an absolute speed limit of 55 MPH. Anything with more than 2 undivided lanes and the speed limit is 65 MPH. The only exception is when a survey say the 85th percentile speed is at least 5 MPH slower than the absolute. If GA has this type of traffic law, ad there is no justification for the lower speed limit, you could claim the lowered limit constituted a speed trap, which in most states is ILLEGAL and any evidence obtained by the use of a speed trap is not admissible in court.
What was the vehicle code section/ statute you were cited for. I'll do some research for you. I like finding ways to beat my brothers in blue. I think it makes us smarter.
m_chevy: dude, you rock. If that isn't the most convoluted way to beat a ticket I have ever seen................... Very slick

Thanks m Chevy for your help. I tried to get that code from the ticket but half of the shit written on it is illegible. It was a speed trap. While I was pulled over two other patrol cars stopped to check out the bike and see how the popo can easily manage to screw somebody's Saturday in 10 minutes. I had nothing but good attitude. I kind of begged the guy at the end to give me a warning but this is what the fucker said "it is my prerogative to give you a ticket, and I choose to do so. Talk to the judge"
Don't sweat it too much, bro. I've had lots of tickets in my short driving career (not on a motorcycle, though), and I've gotten away with nearly all of them (defered adjudication in TX - pay the fine, stay clear for 90 days, the ticket goes away).
One ticket in your life is not the end of your driving career! You're sweating way too much - you just finally got caught. No biggie, happens to the best of us.
Also, if you go to court on it, and (at least in my state) - if the ticketing officer does not show up, you win! So, go to court, take what you gotta, pay the fine if you have to, and try your damndest to get it dismissed, thrown out, or expunged from your record.
