Are you serious? Shit, I ride with my visor up quite often at lower speeds; it helps cool me down. I honestly never thought someone could get ticketed for that.
Definitely go to court and see what can be done about it.
I must be the only one that hates riding with my visor up. Wind tosses me around with it up. Still it is a BS ticket to be writing. Seriously who cares if my eyes arent covered?

Yes, this seriously is a bs ticket. I like riding with my visor down because everytime it's up I seem to get nailed in the eye with the biggest bug around. Good luck and I would definitely fight it.
What can you fight? It's a driver/riders job to know the laws - so the "I'm not from here" doesn't matter. It is a law, you admit to violating it...
I do the same thing a lot; however, there are cops @ the universities all the time ticketing for that, and like it or not it's a law :-/
sounds like NAS and corry sation then, because these two cops where out on the main strip outside both bases just pulling people over left and right.
He wanted to give me a ticket. My bike and my DL are both out of state, i'm only here for MOS training. He asked me why I got pulled over. I said no, then he explained why. I said I'm from texas and he cuts me off and says I don't want to hear about what they do in texas. So good to go, no reason to get an attitude. I was kinda still hoping for a warning but no 75 dollar ticket.

I would fight it. Tell the magistrate you opened it because you were fogging up and couldnt see.
Do they not allow open faced helmets there? Goggles required? Do all the Harley/cruiser riders have full face helmets then? That would be a good sight to see. What a BS ticket man, good luck with it. If you're in town long enough, fight it. I would go to the Law offices there on base and see what they think.
In MD you have to have eye protection anytime the bike is in motion. So at a light your cool to put it up but you have to remember to put it down. If your stationed in Fl and have a Tx license, I would find out what if any points the ticket carried and if they will show up on your Tx license. If the ticket isn't going to show up, or there are no points, do you really want to waste a day in court trying to fight something when you know your wrong? Not to mention if you lose you may have court costs added on to the 75 dollars. I agree it is BS ticket, but you were wrong pay the ticket and chalk it up to experience if it doesn't affect your insurance. If the points are going to show up then go to court and try to get the points knocked down so that your insurance doesn't go up for the next 100 years.

he was saying something about it being a citation, and that I didn't have to worry about any points. So yeah I guess I will end up paying the 75 next saturday when I get time off and be the end of it. I'm still a little bitter about it, but there really isn't anything I can do.

Yes, it may be braking the law however from my perspective and I'm sure many others' this is overly nit-picky. I would try and chalk this one up to the officer having a bad day, maybe he just got out of court after some one took a similarly petty ticket to court; that would ruinn my day if I was LEO.
I bet that guy is really busy during Bike week(being in Florida and all) or does he take his vacation at that time?
That will get you a ticket in Tennessee...eye protection is absolutely required. And as far as fighting it because you are from a state where it's not required, that won't work. Ignorance of a law is no excuse...if you drive in a state, you are expected to know and abide by the laws of that state. Now, for my personal opinion of the ticket and the cop who gave it to you...that's a BS ticket by an asshole cop who had nothing better to do than harass a rider who was probably wearing a helmet that exceeds the minimum requirement. Just think of all the jackass Hardley riders with their little beanie helmets and sunglasses that didn't get harassed!

I don't dispute it was nit-picky, and I probably wouldn't write someone for it. I might pull you over for it, but only if I was hunting a more serious crime like DUI. And yes for you idiots that like to drink and ride I take DUI very seriously. I don't mean one or even 2 depending on time frame. I mean the ones that take 10 mins to get into their car, or remember how to put the stand up. I have seen to many people hurt and killed by a dumbass behind the wheel after to many drinks.
