Im 17 and I was out with my gf last night driving and I got arrested. i got a ticket for doing 62 in a 40 mph zone, charged with DWI (had about 4 beers and failed the breathalyzer) and my gf had about .2 grams of weed and a bowl pipe with residue in it. so I told them that was mine and got charged with possession. Plus they gave me a ticket for having a headlight out. Now I know this was the absolute stupidest thing I have ever done and Ive already heard all the preaching so dont bother, Im done with all of this stuff and it will never happen again. But what should expect at my court date? I have one previous ticket that left 4 points on my license. What kind of punishment do you guys think Ill get?

Your pretty much screwed from what I'm reading. Here's what I would do. Go early the morning of the court date, talk with the ADA and tell them what you will plead to a lessor offense if they will drop the speeding, headlight, and simple poss charges. In NC we have a lessor charge for DWI under the age of 21, its called Driving after Drinking under the age of 21. Its basically a DWI for people that aren't 21. It allows them to get a provisonal license to drive back and forth to work, school, the store and thats about it. But its better then nothing.

Get a lawyer. Laws vary from state to state, but in general there is zero tolerance for DWI especially for minors. To some extent the fact that you're not 18 may be a plus. A lawyer may be able to keep this in juvenile court and prevent an adult record this time. A lawyer will cost some $$, but may prevent a much more expensive outcome (fines, loss of license, rehab charges, plus a bunch more). In CA as an adult that can add up to $10-15k plus jail time plus community service plus loss of license etc.

In summary, get a lawyer who knows how to defend DWI especially for minors. I hope you truly have learned your lesson. If there is a next time, it be REALLY painful.

I am not going to preach to you, but take this as a learning experience and stay way from drinking and driving and drugs all together. If your girl is into drugs get another girl!!

Now that being said, the best advice I can give you is to get a lawyer and see what he can work with out the state's attorney. Lawyers are expensive but if you try to take it to trial or plead it out yourself you going to get hammered. I see people take things to trial with out a lawyer and try to represent them selves and get screwed, because the state is a lawyer and knows what and how and to ask questions, and the cop goes to court at least once a week so knows how to testify.

+1. And if you're too broke to afford a sport bike now, you haven't seen your insurance rates after they get a hold of this one on your driving record. Sucks to be you. And out of curiosity, just what was your breathalyzer? I'm curious. Here it's 0.08 for an adult and the charges are higher if you blow a 0.16 or higher. And if you're a minor, it's a 0.02 that you can blow. So, where on the scale were you?

BTW, if you're still 17 and not legally emancipated and not somehow being charged as an adult, your parents or guardian are still legally responsible and will likely have to appear with you in court. I hope they're with you on this and will help with the lawyer. You should be figuring out how to pay this bill, however. Good luck.

-yes I am a fucking idiot and I swear to god after this Im never drinking or going near drugs again. Its NOT worth it and I know you might not believe what Im saying but there is no doubt in my mind that Im done with all of that even after I turn 21.

-Im pretty sure Ill lose my license for at least 6 months, probably a year, not to mention a ton of fines and probably community service.
-If anyone else drinks and drives, learn from my example. I had a great life and I basically lost everything overnight. dont drink and drive no matter what. Its the stupidest fucking thing ive ever done
