Default accident advice

Okay, so in the open forums I started a thread about my car accident I was in a week and a half ago.

Our insurance company just called my dad and told him that the people in the other car were being represented by an attorney. I was at fault in the accident and got a ticket for failure to pay full attention to driving. Nobody was hurt, the paramedics showed up and just ended up pretty much putting a band-aid on the little girl that was in the other car. Nobody was transported, nothing.

My dad is afraid that HE is going to get sued for thousands of dollars, because he owned the truck, but the insurance was in my name, and I was driving. Just for information, the girl was only cut because they had 6 people in a 5 person car and she wasn't wearing a seat belt. Is it really likely that they're going to try and sue? should I be trying to talk to a lawyer instead of posting this here? I don't know! any ideas?

You will be the one that likely gets sued. Your name is on the insurance, they may name your father in the suit just because he owns the truck, however you are the one driving and carrying insurance on it.

I would go ahead and find an attorney, they the other party already has one its a good bet you are fixing to get sued.

I don't really understand what I could get sued for though. I thought that was mainly just to get money for repairs and medical and shit, but nobody was injured, and there wasn't much damage to other car at all, a new rear quarter panel and some other shit, but my insurance covered that.

So should I look for them to all be wandering in to the courtroom with neckbraces and blackeyes?

Most of the time its pain and suffering that you are getting sued for.

Since you seem to have the info already, I would be quick to note the lack of serious injury and damage to the vehicle. I would get a lawyer and do it quick. Your gonna pay somehow. Here where I live however, if someone is trying to sue someone for pain and suffering, the judge will throw it out if all u did was blacken their eye.

Doesn't the insurance company pay your legal fees? I thought that was part of the insurance package.

I wouldn't jump to conclusions yet. Write down everything you can remember about
the accident date ,time, road conditions, traffic, medical response, the fact the child was not in a seat. Don't spend alot of money hiring a lawyer until you recieve the suit IF it comes. Keep records of any phone calls, names of who you talked to / anything related to the accident. Their first contact would be your insurance Co. going to bat for you

You better get a lawyer, your gunna need one. I ran into a old guy many years ago going less than 10mph when I hit his car. No one was even scratched. My cars (a 1974 Z-28) bumper was lower than his so my grille got smashed out and nothing else. The old guy sued for 100,000 and got 30,000 from my insurance!

No ambulance came or nothing, both cars were driveable. No cops came either we exchanged info that was that. A week later I got the call from Alstate.

The insurance company will provide an attorney to to protect the intrests of the insurance company, if they don't get what they want out of the insurance company they can still go back and sue you as an individual. The person they really want is the ins. company because they have deeper pockets. Just be careful and watch what you say to their attorney and their insurance company and tell them to speak to your insurance company if they call.

dont talk to ANYONE unless YOUR insurance company tells you to
happen to me a few years ago i was in a minor accident and everything was fine till the guy found out no one was going to be paying to get his car fixed then he was hurt. i had just about no involvment in the whole process, i got a phone call from the insurance company telling me i was getting sued and then another one telling me it was over and that was it
