Funky Ticket
I got a ticket early last year, my court date was postponed until around august. Once it was all said and done, my license ended up being suspended. However I was given a work permit. The lady who was writing up the final paperwork on this work permit asked me what time I needed to be able to drive to and fro from work. I told her my shifts change from day to day I needed a fairly broad availability. We settled on 9am to 6pm. My license was only to be suspended for 30 days exactly. On this work permit it simply stated my name, address, drivers license number, birthdate, and time I was allowed to drive. There were no other implications or restrictions stated on this permit, or any other piece of paperwork attached to this permit. The day (and I do mean the very next day) my license became valid again, and the permit was lifted, I got pulled over. At the time I did not have my license (i worked the same exact hours as the court house is open, in a town 30 miles away from this court) all I had on me was the work permit, which was then expired. The officer of course asked me If I knew why he pulled me over. I politely said, "no, I have no idea why you pulled me over" Because my speedometer showed me to be moving at 67 mph. The highway I was on had a posted speed limit of 70 mph and no minimum speed limit posted. The officer told me that he pulled me over because I was doing 63 mph, slower than the rest of traffic. He asked to see my license and I told him I did not have it on me, all I have is a permit for proof of license. I gave it to him. He went back to his car, came back again and asked me to step out of the vehicle. At the time I was driving my grandmother's 1989 Oldsmobile Cutlass, with a disabled license plate on it, with valid insurance. Once out of the car, he searched me (im still in my work uniform) and he completely searched the car, asking me several times over if I smoked weed, or did Meth. Which I do not, and told him. The time he pulled me over was 8pm. Another police officer pulled up whilst he was searching, and was looking at me. He asked me "hey you look familiar, have I arrested you before?" I said "im sorry no, I have not ever been arrested." Once back in the car, the officer wrote me a ticket for driving outside my parameters on a suspended license (even though on the permit it specifically shows the date effective) he also gave me a warning for one of my two license plate lights being out. I felt quite offended for the statement made by the arrived officer, and for being searched randomly for drugs when I had been pulled over for apparently going to slow. Basically I was wondering if n e one knows how well that ticket will stand? And of course I would love to hear opinions on how being in that situation would make you feel. Sorry for the long wind. Thanks for info

This is what gives us bikers a bad name. Not only do I ride a motorcycle I'm an officer to. In NC I can go up to two years and still give you a ticket for something. It doesn't have to be right away. In your case why not man up to it and take the ticket, you clearly stated you pulled the wheelie, so why not be a man about it, oh thats right the po po is out to get people. Grow up and be a man about it and come back and talk to us real adults.

So if I get this right, you were stopped for going to slow (which happens sometimes on a major highway) and giving a ticket for driving outside your permit. Was the permit dead? Can you apply to have your license reinstated? If so go ahead and do that before the court date, If not then talk to the DA and explain that you were on your way home (within the time limit) and you were stopped for going to slow.

Er but isn't it true you can't give some one a ticket simply based on another persons word?? After all the maniac that called it in was doing donuts on the freeway...see my point. The problem isn't not being man enough to pay up to the institutions we all empower and allow to exist in the first place, the problem is how they constantly screw the people they claim to serve. Don't argue because yes you do, some one calls claiming a motorcyclist on a gsxr did a wheelie you can not think you found them a 1/2 hour later and give them a ticket you prick, a warning yes a ticket no. Sorry but you're clearly a cop with a bad attitude. I know you guys get tons of flack from all corners for what is a honorable service but that flack is grounded in the realities of your conduct. Why don't you be man enough to say that this guys ticket is bogus as well as the one that started this thread. As you said grow up boy.

ROFL, glad we have so many lawyers in here. Hell I guess us cops should just stop posting since we seem to have so many lawyers that know the law better then we do.
How do you think people obtain warrants? Its based on other peoeple's statements. There has to be a clear evidence that the vehicle matches, I.E. clothes, tag, color, etc. SOL on mis. charges are two years, felony's depending on what they are sometimes never die.

NCG I think what he was getting at is even if someone called in and described his bike, he may have passed them at 7 or 80 but maybe they have a grudge against motorcycles so out of shear spit they could call in and say you were doing a wheelie, and you would get a ticket.
And for the first poster I beleive that if you didnt bother to go get your regular license than you are technically under the restriction as long as you hold that card. I THINK.
But I do think they way you were treated and the reason you were pulled over is BS.

I understand what he was saying, I it probably does happen, but if the caller goes and swares out a statement then there is something going to be done about it.

<THREAD HIJACK - sorry OP>
Understandable, but isn't that sworn statement just justification to look into the matter instead of automatically assigning guilt? Innocent until proven guilty and all that? I can sign sworn statements all day long...doesn't mean what I am saying is true. Hell, if a sworn statement is all it takes, I'll sign one every time someone cuts me off or drives me off the road that he was molesting a 9 year old boy while smoking crack in the car he cut me off with...provide the tag number and everything. He may not get anything for the crack or the kid since none will be there when he gets pulled over, but they should still get a ticket for cutting me off (which is illegal where I live). Right?
</THREAD HIJACK>

You hear alot of officers including myself say that we don't always agree with the law, but we are sworn to uphold it.
Just like the whole pot thing.
