Actually, no he can't. Giving someone (including a cop) the finger is protected by your constitutional right to free speech.

That wouldn't stop him from following you until he found you doing something wrong, though.

And if you were riding, he'd probably bust you for improper use or something stupid for taking your hand off the bars to do it.

I thought it was "Flipping" off. Flicking is something you do with stuff that comes out of your nose.

I agree with you partly... flipping me off doesn't bother me, but you're gonna get pulled over and I'm gonna check to make sure your helmet is DOT compliant, you got your license and insurance, your registration is current along with your inspection, your tires tread is thick enough, and several other little known vehicle laws that I may have to break out the book to find. If I find it you can bet I'll give you a ride to the pokey and tow your bike.

On the other hand (or finger) if someone was around that was offended by it, you would be arrested for Disorderly Conduct... at least here in Texas. In this case you would also get a ride in a 2005 Crown Victoria, complete with hard plastic seat (which the guy before you probably pissed on or threw up on) and too little leg room.

Bottom line is if you don't want any problems, why do it?

Another point is that you can be arrested for it. No one said the Officer cant be offended. Its just not recognized by the courts..So the true bottom line..You might be able to beat the case in court..but you are still going to take a ride..not worth it

least I am number 1 in someone's book!

They can't arrest or charge you with giving them the finger but they can make life hard for ya mang. I really wouldn't suggest doing this.

Yeah I would never do this honestly. I have great respect for you all. My cousin is a NY state Trooper and I am heavly considering to be a FLA state Trooper(FHP). The question was purley and honestly just out of curiosity. Im going to sign up for a couple ride alongs and check to see if oyu can do it with the FHP. I'm just thinking I'll prefer FHP to city/county cop due to the high level of domestic calls, but who knows what I'll think. I'll have a much better idea after the ride alongs.

Ride alongs are great to see how things work and see it from a different perspective.

It gets worse.......you can burn a cross in your yard...but not someoen else's. You can exhibit schwasticas (can't remember exactly how to spell it). Both are protected by The Constitution.
