Default i seriously need some legal advice

ok, so i pull into work in my car last thursday, nothing out of the ordinary, just park and go inside. i come back out for break a couple hours later and find out that my front fender is smashed in and a big scratch down the side, but not another vehicle anywhere near it. i immediately call the police to file a hit and run. as i'm waiting for the policeman to show up a coworker of mine comes up and tells me his girlfriend hit my car when she was leaving the parking lot. so i tell the officer that i found out who it was and that we were going to make arrangements our selves to pay for damage, since neither him or his girlfriend have driver's licences or insurance. his girl is also fighting to get her kids back, so she really doesn't need a setback. anyways, we decide that instead of paying for the damage it would make more sense for him to just buy the car. with that in mind i went out and bought a truck today. when i get to work i find out that he is quitting and probably won't be back tomorrow night. so what if he doesn't pay me? is there any legal action i can take even though i told the officer i didn't want to press charges? or should i just suck it up and accept the fact that i might get fucked? thanks ahead of time.

Youu have a year from the date of the incident to press charges against the person. Did they get the other driver's info or do a report or anything??

You can charge them with hit and run in criminal court and/or sue them in civil court for the damages. Like I said, you have a year to file charges in either or both courts.

dude thats why you always call that shit in. They shouldn't be driving without a licence or insurance anyways. I'd give him a call and give him a time fram and tell that if he doesn't work something out immediately that you'll press charges.
