attn: if you are given a ticket do you have to give it back?

I was given a ticket for expired tabs and speeding. after it was handed to me he asked for it back because he for got to write no proof of insurance.i to him that he can wright another ticket , because the one he wrote me was my leagal copy to apear. he then told me i was under arest for obstrucing justice. as far as i know i am correct please tell me if i am wrong. thanks

Sounds like he made a mistake and didn't want you to get away with it, but what do I know. I want to hear what Officer737 has to say about this.

Yes he can ask for it back to make corrections as long as it is during the initial stop. Did they make the correction and then give your copy back?

I would have just written another citation, would have been less drama.

I'm no law enforcer or lawer but once you sign the document you shouldn't be able to make any changes because he could add anything to that ticket without you knowing about it. It would have been less paper work to just write another ticket. Just my 2 coins.

Good point! That's why the officer asked for their copy back to make the proper correction. They can argue in it court all they want to but the judge will more than likely side with the officer on this one but will probably throw the obstruction charge out.

thanks 737 that would have been the way to go for them I just got off of westlaw and it does say a ticket is a leagal document so by them taking it back the officer himself did obstruct justice!I Feel like i live in maybary

In NC by signing a ticket you are not signing for the charges, you are signing that you promise to appear in court.

that is the way it is here in ks. however, the officer is no longer required to get the drivers signature. when the officer hands the citation over (as soon as the paper touches you) you have been served no matter if you sign or not.

Thats the way it works in MD too, and if you refuse to sign a ticket you are arrested.
